Terms of Service

1 Service

Bentrix will provide services in a timely and professional manner.
Please allow up to 48 hours for a response to your initial order. Exceptions may apply  (see off duty schedule).

1.1 Hours of Operation

The services are provided Mon-Fri between regular business hours 9am − 5pm CET (Central European Time). Hours of operation exclude all Swedish Holidays.

2 Disclaimer of Warranty

ALTHOUGH BENTRIX CANNOT GUARANTEE THAT A SERVICE WILL BE SUCCESSFUL, BENTRIX WILL MAKE ALL REASONABLE EFFORTS TO PERFORM SERVICES UNDER THE DEFINITION OF THE SERVICE IN A PROFESSIONAL MANNER. TO THE EXTENT PERMITTED BY LAW, THE EXPRESS WARRANTY AND REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LEIU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. AS PERMITTED BY APPLICABLE LAW, BENTRIX SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, RELATED TO OR ARISING IN ANY WAY OUT OF THESE TERMS AND CONDITIONS, INCLUDING ANY IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

3 Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, BENTRIX LIABILITY UNDER THESE TERMS AND CONDITIONS IS LIMITED TO THE AMOUNTS PAID BY CUSTOMER FOR THE SERVICE PURCHASED BY CUSTOMER. IN NO EVENT SHALL BENTRIX HAVE ANY LIABILITY FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOSS OF DATA, LOSS OF USE OR EQUIPMENT OR FACILITIES, OR INTERRUPTION OF BUSINESS, ARISING IN ANY WAY OUT OF THESE TERMS AND CONDITIONS UNDER ANY THEORY OF LIABILITY, WHETHER OR NOT BENTRIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Bentrix will not be liable for performance delays or for non-performance, due to causes beyond its reasonable control.

4 Term and Termination

A bought service can be fully refunded as long as it has not  provided in full or in part. After representatives of Bentrix has started working on the bought service, even if it’s just investigation, it will not be refunded in full or in part, unless at the discretion of Bentrix. Issues found later than 5 days after a service has been completed will not be considered as part of the service. If any questions or issues arises after 5 days it will be considered a new issue and new funds must be made available upon request.

5 Privacy Policy and Data Protection

Customer agrees and understands that it is necessary for Bentrix to collect, process and use customer data in order to perform the ordered services. Bentrix and its authorized representatives, will keep confidential all customer data obtained during the course of providing services.

6 General

A waiver of any breach or default under these Terms and Conditions shall not constitute a waiver of any subsequent breach or default.

If a court of competent jurisdiction holds that any provision of these Terms and Conditions is invalid or unenforceable, the remaining portions of these Terms and Conditions will remain in full force and effect, and the parties will replace the invalid or unenforceable provision with a valid and enforceable provision that achieves the original intent of the parties and economic effect of the Terms and Conditions.

These Terms and Conditions, including any additional terms referenced herein, constitute the entire agreement between the customer and Bentrix with regard to service purchases and services provided hereunder and supersedes all prior negotiations, agreements, and understandings with respect to the subject matter, and no addition to or deletion from or modification of any of the provisions hereto shall be binding upon Bentrix unless made in writing and signed by an authorized representative of Bentrix. Any term or condition on any order or other document submitted by the customer shall be of no force or effect whatsoever, and is specifically rejected.
